Mariah Yeater seems pretty confident in her claim that Justin Bieber is the baby daddy to her 3-month-old baby. Yeater, 20, filed a paternity suit against the teen singer on Monday in San Diego.

Bieber himself has outright denied that he ever met Yeater, and is certainly not her baby's father.

An article in People points out the fact that a simple swab of Bieber's cheek may clear up this baby drama quickly, and that a DNA test may be ordered by the Judge in this case.

The judge has to weigh two things: Bieber's right to privacy versus the child's right to know who the father is," L.A. family law attorney Steve Mindel (who is not involved with the case) tells PEOPLE. "Unless the judge thinks the woman made everything up, the court will likely order the test as the quickest resolution."

Adds Mindel: "If Bieber indeed never met this woman, a DNA test may be the only way to clear his name."

A court hearing is scheduled for Dec. 15, and Bieber is required to file a response to the lawsuit before that date.
